The service

Gabriele Serpi (GSFLASH PRODUCTION), VAT IT18239851001, certified email (PEC) gabriele.serpi@pec.fiscozen.it provides the online services TallyFlow, UTCflow, Sottotitoli Live, PTZFlow (the "Services"), accessed with a GSFLASH account. By using the Services you accept these terms.

Account

The account belongs to you or your organisation. You are responsible for what happens with your account and for keeping login links, room codes and PINs confidential. Reselling, renting or giving access to the Services to third parties, or using one account for several different clients, is not allowed. Colleagues working with you log in with their own account, within your plan limits.

Plans, prices and payments

Prices are those shown on the pricing page at the time of purchase. The provider uses the Italian flat-rate tax scheme: VAT not applied. Subscriptions renew automatically and can be cancelled at any time from your account: they stay active until the end of the paid period. Passes and prepaid years do not renew. Free trials are one per person, device and organisation; using several accounts to get more trials leads to the closure of those accounts.

Right of withdrawal (consumers)

If you are a consumer you have 14 days to withdraw from a purchase. By asking for a digital service to start immediately, you accept that the right of withdrawal is lost once the service has been fully provided (for example a pass used for an event).

Fair use

You may not use the Services for unlawful activities, to spread offensive content or content that infringes others' rights, to try to access other people's rooms or data, to overload the systems, or copy, decompile or reverse engineer the software, except where the law allows it. The software, trademarks and content of the Services belong to Gabriele Serpi (GSFLASH PRODUCTION).

Your content and third-party data

The content you enter (texts, transcripts, names, logos) remains yours. We only need the rights required to provide the Service. If you process other people's data in the Services you are the controller: we act as processor (art. 28 GDPR), process that data only to provide the Service and following your instructions, with adequate security measures, delete or return it at the end of the relationship (the captions archive is deleted after 6 months) and use the providers listed in the privacy notice. You are responsible for having a legal basis for that data and for informing the people concerned. A dedicated agreement can be signed for special needs.

Availability and live events

We do our best to keep the Services always available, but we cannot guarantee they work without interruptions or errors: they also depend on the internet, venue networks and the devices used. The Services support your production: for events where an interruption would have serious consequences, prepare a backup (for example a second connection or an operator). Automatic captions may contain errors.

Liability

To the extent permitted by law, the liability of Gabriele Serpi (GSFLASH PRODUCTION) towards business customers is limited to the amount paid for the Service in the previous 12 months and excludes indirect damages, lost profits or data loss not caused by gross negligence or wilful misconduct. Consumers keep all the rights granted by law.

Suspension and closure

We may suspend or close an account that breaches these terms, with notice when possible. You can close your account at any time by writing to gabriele@gabrieleserpi.com.

Changes

We may update these terms. For important changes we notify you and ask you to accept them again at your next login.

Law and courts

Italian law applies. Consumers may use the courts of their place of residence. For business customers, the courts of the provider's place of residence have jurisdiction.
